Who Is On My Wifi v4.0 is protected by United States Federal Copyright Law. IO3O LLC (“IO3O LLC” or the “Owner”) retains the title to and ownership of Who Is On My Wifi v4.0 (the “Product”).  IO3O LLC retains the copyright and trademark of the Product, as well as all rights not expressly granted.  The licensee is defined as the individual or company utilizing the Product (“Licensee”).   IO3O LLC grants the Licensee a non-transferrable license to use the Product under the following terms and conditions (the “Agreement”): 
LICENSE: IO3O LLC hereby grants the Licensee a nonexclusive license authorizing the Licensee to use the Product on one computer for an unlimited length of time without guarantee of continued functionality. 
RESTRICTIONS: Licensee may not remove any proprietary notices, labels, trademarks, or documentation on the Product. Licensee may not modify, de-compile, disassemble, reverse engineer or translate the Product. Licensee may not repackage, rebundle, or otherwise combine the Product into compilations for resale. Licensee may not rent, lease, lend, sell, redistribute or sublicense the Product.
TERM:  Licensee may terminate its License and this Agreement at anytime by uninstalling and destroying all copies of the Product. The license will terminate automatically if Licensee fails to comply with any term or condition in this Agreement.
LICENSEE CONDUCT:  Licensee must agree to behave in the following manner while using the Product.
A. Licensee will not use the Product to commit or help to commit any act that is unlawful, harassing, obscene, discriminatory, or otherwise objectionable.
B. Licensee will not install or use the Product on a computer or computer network over which the  Licensee does not have ownership or control.
C. Licensee will not harm any third party or violate copyright laws by use of the Product.
JURISDICTION:  This license agreement shall be governed by the laws of Oklahoma.
NO WARRANTY: The Licensee expressly acknowledges and agrees that use of the Product is at the Licensee’s sole risk.  To the extent permitted by applicable law, the Product and any services performed or provide by IO3O LLC are provided “as is” and “as available” with all faults and without warranty of any kind, and IO3O LLC hereby disclaims all warranties and conditions with respect to the Product and any services, either express, implied or statutory.  IO3O LLC does not warrant against interference with the Licensee’s enjoyment of the Product, that the functions contained in, or services performed or provided by the Product will meet the Licensee’s requirements, that the operation of the Product or services will be uninterrupted  or error-free or that defects in the Product will be corrected.  No oral or written information or advice given by IO3O LLC or its authorized representative shall create a warranty.  Should the Product prove defective, the Licensee assumes the entire cost of all necessary servicing, repair or correction. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusion and limitations may not apply to the Licensee 
LIMITATION OF LIABILITY:  To the extent not prohibited by law, in no event shall IO3O LLC be liable for personal injury, or any incidental, special, indirect or consequential damages whatsoever, including, without limitation, damages for loss of profits, loss of data, business interruptions or any other commercial damages or losses, arising out of or related to the Licensee’s use or ability to use the Product, however caused, regardless of the theory of liability (contract, tort or otherwise) and even if IO3O LLC has been advised of the possibility of such damages.  Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to the Licensee.  In no event shall IO3O LLC’s total liability to the Licensee for all damages (other than as may be required by applicable law in cases involving personal injury) exceed the amount of fifty dollars ($50.00). The foregoing limitations will apply even if the above stated remedy fails of its essential purpose.
INDEMNIFICATION:  Licensee agrees to indemnify, defend and hold harmless IO3O LLC, its officers, and employees from all liability involving the violation of law, statutes, and regulations, either directly or indirectly, by Licensee through the use of the Product.
